Mary Mubaiwa’s Application for Stay of Prosecution Dismissed

Mary Mubaiwa, the ex-wife of Vice President Constantino Chiwenga, has had her application for a permanent stay of prosecution on medical grounds dismissed by the Harare Magistrates Court.

Court Decision Sparks Outrage

Following the court’s ruling, Mubaiwa’s lawyer, Beatrice Mtetwa, expressed her frustration, stating, “It’s logic that I cannot understand.”

This dismissal comes as Mubaiwa has been battling severe health issues for over four years, during which she has lost both her right hand and left leg due to lymphoedema.

Serious Charges Against Mubaiwa

Mubaiwa is currently on trial for allegedly attempting to kill her ex-husband, former Army General, now the Vice President Constantino Chiwenga, during his hospitalization in South Africa.

In addition to the attempted murder charge, she faces money laundering allegations.

However, her criminal proceedings have faced significant delays due to her deteriorating health.

Ongoing Health Struggles

Mubaiwa’s health challenges have raised concerns about her ability to participate fully in her defence.

Her legal team argues that her medical condition should warrant special consideration in the judicial process.

Despite these arguments, the court has ruled against granting her a stay of prosecution.

As the situation unfolds, it remains to be seen how Mubaiwa’s health will impact the ongoing legal proceedings and what further steps her legal team may take in response to this latest ruling.
